terms of service
Last updated 10 August 2026
1. Agreement to terms
These Terms of Service (“Terms”) are a binding agreement between you and BuildingPP OÜ (registry code 17224732, Laulupeo 3-2, Tallinn, Estonia) (“Company”, “we”, “us”), governing your use of the semory mobile application and website (together, the “Service”). By using the Service you agree to these Terms; if you do not agree, do not use the Service.
Our Privacy Policy is incorporated into these Terms by reference. We may update these Terms by posting a revised version and updating the “Last updated” date; continued use after changes take effect constitutes acceptance. Questions: sander@bilt.me.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf. You warrant that your registration information is accurate and that your use of the Service complies with applicable law.
3. Your account
You may need an account to use the Service, created with your email or by signing in with Apple. You are responsible for safeguarding your credentials and for activity under your account.
4. Your photos
You own the photos you shoot with semory. By using the Service you grant us a limited, non-exclusive license to store, process, and transmit your photos solely as needed to operate the Service — holding them until they develop, returning them to you, and showing them to the friends you have accepted. We do not use your photos for any other purpose.
The nature of the Service is intentional delay: photos are unavailable to you until they develop. While we maintain backups, you acknowledge that we are not liable for loss or corruption of photos or other user data, and you should not use semory as the sole store of irreplaceable content.
5. Fees and payment
Paid features and subscriptions are billed through the Apple App Store, under Apple’s payment terms. Prices are shown in-app and may change. You can cancel a subscription any time in your App Store account settings; cancellation takes effect at the end of the current billing cycle.
6. Refunds
Purchases made through the App Store are refunded through Apple under Apple’s policies. If you believe you are owed a refund, request it from Apple first, or email us and we will try to help.
7. Prohibited activities
You may not:
- Break the law, or use the Service to harass, abuse, or harm others.
- Upload unlawful content.
- Reverse engineer, decompile, or copy the Service.
- Use bots, scripts, or other unauthorized automated access.
- Interfere with or disrupt the Service or its security.
8. Intellectual property
The Service — its code, design, text, graphics, and trademarks — is owned or licensed by us and protected under Estonian, EU, and international law. You get a limited, personal, non-commercial license to use it. Feedback and suggestions you send us may be used by us without compensation.
9. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate access that violates these Terms. On account deletion, your data is erased as described in the Privacy Policy.
10. Modifications and interruptions
We may modify or discontinue the Service, or parts of it, at any time. We do our best to keep semory available but are not liable for downtime.
11. Disclaimer
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amounts you paid us in the six months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, or the statutory rights of EU consumers.
13. Indemnification
You agree to indemnify us against claims arising from your violation of these Terms or your unlawful use of the Service.
14. Governing law and disputes
These Terms are governed by Estonian law. Disputes should first be raised with us informally by email. If unresolved, disputes may be brought before Harju County Court in Estonia — or, if you are an EU consumer, the courts of your country of residence. EU consumers may also use the European Commission’s online dispute resolution platform.
15. Miscellaneous
These Terms are the entire agreement between you and us regarding the Service. If any provision is found invalid, the rest remain in effect. You consent to receiving communications from us electronically.
